GENERAL RELEASE

This Liability Waiver, Assumption of Risk, and General Release (“Agreement”) is entered into between the participant (“Participant”) and Lox & Loaded, including its affiliates, officers, directors, employees, volunteers, instructors, chapter leaders, partners, sponsors, venues, agents, representatives, and assigns (collectively referred to as “Lox & Loaded Parties”).

By signing this Agreement or participating in any Lox & Loaded event, activity, training, meeting, or program, Participant acknowledges and agrees to the following:

1. Participant Eligibility

Participant represents and warrants that:

  • Participant is at least 18 years of age, mentally competent, and medically capable of participating in activities involving firearms.

  • Participant is legally permitted to own, possess, and use firearms under all applicable federal, state, and local laws.

  • Participant has no legal restrictions that would prevent lawful firearm possession or use.

If Participant is a minor, the parent or legal guardian signing below grants permission for the minor to participate and agrees to all terms of this Agreement on the minor’s behalf.

2. Firearm Ownership & Legal Responsibility

Participant acknowledges that Lox & Loaded does not provide legal advice regarding firearms.

Participant is solely responsible for understanding and complying with all applicable laws related to:

  • Firearm ownership

  • Firearm transport

  • Concealed or open carry

  • Ammunition restrictions

  • Use of firearms at ranges or other venues

Participant agrees that they will remain fully compliant with all applicable laws at all times.

3. Safety Compliance

Participant agrees to strictly follow all safety rules and procedures, including but not limited to:

  • The Four Fundamental Rules of Firearm Safety

  • All instructions provided by instructors, range officers, event coordinators, or venue staff

  • All policies and procedures established by Lox & Loaded

  • All safety rules of the host range, venue, or facility

Participant agrees to:

  • Handle firearms safely at all times

  • Use proper eye and ear protection

  • Maintain control of their firearm at all times

  • Immediately report unsafe conditions or behavior

Failure to follow safety rules may result in immediate removal from the event and termination of membership.

4. Assumption of Risk

Participant acknowledges that firearm training, shooting activities, and related events involve inherent risks that may result in:

  • Property damage

  • Serious bodily injury

  • Permanent disability

  • Death

These risks may arise from:

  • Firearm discharge

  • Mechanical failure of equipment

  • Actions of other participants

  • Environmental hazards

  • Negligence of participants or third parties

Participant voluntarily assumes all risks, both known and unknown, associated with participation in any Lox & Loaded activity or event.

5. Waiver and Release of Liability

Participant knowingly and voluntarily waives, releases, and forever discharges the Lox & Loaded Parties from any and all claims, liabilities, damages, losses, or causes of action arising from:

  • Personal injury

  • Death

  • Property damage

  • Participation in any Lox & Loaded event or activity

This waiver applies even if such injury or damage results from the negligence of the Lox & Loaded Parties.

6. Covenant Not to Sue

Participant agrees that they will not initiate or pursue any legal action against Lox & Loaded or the Lox & Loaded Parties for any claim related to participation in Lox & Loaded events.

Participant further agrees that if any claim is brought in violation of this Agreement, Participant will be responsible for all legal costs and attorney fees incurred by Lox & Loaded.

7. Indemnification

Participant agrees to defend, indemnify, and hold harmless the Lox & Loaded Parties from and against any claims, damages, liabilities, losses, or expenses arising from:

  • Participant’s actions or negligence

  • Participant’s misuse of firearms or equipment

  • Participant’s violation of laws, rules, or safety procedures

8. Equipment Responsibility

Participant acknowledges that they are responsible for the safe condition and proper functioning of any equipment they bring to an event, including but not limited to:

  • Firearms

  • Ammunition

  • Holsters

  • Protective equipment

  • Accessories

Lox & Loaded does not inspect or guarantee the safety of participant-owned equipment.

9. Substance Policy

Participant agrees not to participate in any Lox & Loaded event while under the influence of alcohol, illegal drugs, or any substance that may impair judgment or physical ability.

Lox & Loaded reserves the right to remove any participant suspected of impairment.

10. Medical Authorization

Participant authorizes Lox & Loaded personnel or event organizers to seek emergency medical treatment on Participant’s behalf if necessary.

Participant understands that:

  • Emergency services may be contacted

  • Medical treatment may be administered

  • Participant is responsible for any medical expenses incurred

11. Photography & Media Release

Participant grants Lox & Loaded permission to photograph, record, or otherwise capture Participant’s likeness, voice, or participation during events (“Media”).

Participant grants Lox & Loaded unrestricted, perpetual rights to use this Media for:

  • Marketing

  • Promotion

  • Social media

  • Websites

  • Advertising

  • Educational content

Participant waives the right to compensation or approval of such materials.

12. Membership Suspension or Removal

Lox & Loaded reserves the right to suspend, revoke, or terminate membership or event participation at any time for reasons including but not limited to:

  • Unsafe firearm handling

  • Violation of rules or laws

  • Disruptive or threatening conduct

  • Behavior inconsistent with Lox & Loaded values

No refunds will be provided for revoked memberships.

13. Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of the State of Ohio, without regard to conflict-of-law provisions.
